Frequently asked questions

A former employee works for a competitor and contacts our customers: what can we do?

It depends on the agreements signed, such as non-compete and confidentiality agreements, and on how customers are being contacted. Where there are elements of unfair competition or use of confidential information, urgent action is also possible. The first step is to gather and preserve the evidence.

A competitor uses a trade mark similar to ours: how do we protect ourselves?

I review the mark, any registration, the goods or services concerned and the disputed use. I then assess whether to send a cease-and-desist letter and, where the legal requirements are met, seek urgent measures to stop the unlawful use.

The software supplier is not complying with the contract: what are the options?

The starting point is the contract: specifications, service levels, penalties and ownership of the code. With the help of a technical expert the breach is documented; the options are then to renegotiate, suspend payments within the permitted limits, terminate the contract or claim damages.
